This website, lindamonroe.com, is operated by DMSam Group LLC, a limited liability company registered in the State of Wyoming, United States, with its registered office at 30 N Gould St Ste R, Sheridan, WY 82801. "Linda Monroe" is the trading name of DMSam Group LLC. Throughout the site, the terms "we", "us" and "our" refer to DMSam Group LLC trading as Linda Monroe.

We offer this website, including all information, tools and services available from it, to you, the user, conditioned upon your acceptance of all the terms, conditions, policies and notices stated here. By visiting our site or purchasing something from us, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including the additional policies referenced here and available by hyperlink: our Shipping Policy, Refund Policy and Privacy Policy.

Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission from us.

Section 4 – Products, prices and availability

All prices are displayed in Canadian dollars (CAD). For deliveries within Canada, the price shown at checkout is the total price: shipping is free and all applicable import duties, taxes and customs fees are included and prepaid by us. There are no additional charges on delivery.

Prices and availability are subject to change without notice. Where an item is shown with a reference price and a reduced price, the reduced price is the price you pay. Quantity discounts, when offered, are applied automatically at checkout to eligible items and cannot be combined with other discount codes unless stated otherwise.

We have made every effort to display the colours and images of our products as accurately as possible. We cannot guarantee that your screen's display of any colour will be exact. Measurements in our size guides are taken by hand and may vary slightly. We reserve the right to limit the quantities of any products or services that we offer and to discontinue any product at any time.

Section 5 – Orders and contract formation

When you place an order, you are making an offer to buy the products in your cart under these Terms. We will send you an order confirmation email acknowledging receipt of your order. Our acceptance of your offer, and the contract of sale, takes place when we send you the shipping confirmation email.

We reserve the right to refuse or cancel any order, in whole or in part, before shipping, for reasons including product unavailability, an error in the price or product information, suspected fraud, or orders that appear to be placed by dealers, resellers or distributors. If we cancel an order after payment has been taken, we will refund the full amount paid to the original payment method. If a product is listed at an incorrect price because of a typographical error, we will contact you before shipping and offer you the choice of confirming the order at the correct price or cancelling it for a full refund.

Section 6 – Payment and billing information

We accept Visa, Mastercard and American Express, as well as Apple Pay, Google Pay and Shop Pay. Payments are processed through Shopify's secure, encrypted checkout; we do not see or store your full card details. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store and to promptly update your account and other information, including your email address and payment details, so that we can complete your transactions and contact you as needed.

Section 7 – Shipping and delivery

We currently ship to Canada. Orders are processed within 1 business day and delivered with tracking, usually within 8 to 15 business days of dispatch. Full details, including what happens if a package is delayed or lost, are in our Shipping Policy. If your order has not arrived within 30 days of the estimated delivery date we gave you, you may cancel it and receive a full refund.

Section 8 – Cancellations, returns and refunds

You may cancel an order free of charge at any time before it is dispatched. After dispatch, you may return any item within 30 days of delivery under the conditions set out in our Refund Policy. Items that arrive damaged, defective or different from what you ordered will be replaced or refunded in full. These rights are in addition to the legal warranty and any other remedies available to you under the consumer protection laws of your province or territory.

Section 9 – Optional tools and third-party links

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. Certain content, products and services available via our Service may include materials from third parties, and third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites, and we are not liable for any harm or damages related to the purchase or use of goods, services, resources, content or any other transactions made in connection with third-party websites. Complaints, claims, concerns or questions regarding third-party products should be directed to the third party.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order), subject to Section 5 above.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded or limited under applicable law.

You agree to indemnify, defend and hold harmless DMSam Group LLC and our affiliates, officers, directors, agents, contractors, suppliers and service providers from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

Section 17 – Termination

The obligations and liabilities of the parties incurred prior to the termination date survive the termination of this agreement for all purposes. These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services or by ceasing to use our site. If, in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.
