This Privacy Policy describes how we collect, use, disclose and protect your personal information when you visit, use or make a purchase or other transaction through the Services, or otherwise communicate with us. It has been written to comply with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and the applicable provincial privacy laws, including Quebec's Act respecting the protection of personal information in the private sector, as well as the laws of the other jurisdictions in which we operate. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing and disclosure of your personal information.

Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use and disclosure of your information as described here.

Person in charge of the protection of personal information

Our Privacy Officer is responsible for our compliance with this Privacy Policy and with applicable privacy laws. You can reach the Privacy Officer by email at support@lindamonroe.com (subject line "Privacy") or by mail at DMSam Group LLC, Privacy Officer, 30 N Gould St Ste R, Sheridan, WY 82801, United States.

Personal information we collect or process

When we use the term "personal information", we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:

  • Contact details, including your name, address, billing address, shipping address, phone number and email address.
  • Payment information, including payment card details and other information processed by our payment providers, transaction details, form of payment and payment confirmation. We do not see or store your full card number.
  • Account information, including your username, password, security questions, preferences and settings.
  • Transaction information, including the items you view, put in your cart, add to your wishlist or purchase, return, exchange or cancel, and your past transactions.
  • Communications with us, including the information you include in communications with us, for example when you send a customer support inquiry.
  • Device information, including information about your device, browser or network connection, your IP address and other unique identifiers.
  • Usage information, including information regarding your interaction with the Services, such as how and when you interact with or navigate the Services.

Sources of personal information

We may collect personal information from the following sources:

  • Directly from you, including when you create an account, visit or use the Services, place an order, communicate with us or otherwise provide us with your personal information.
  • Automatically through the Services, including from your device when you use the Services or visit our website, and through the use of cookies and similar technologies.
  • From our service providers, including when we engage them to enable certain technology and when they collect or process your personal information on our behalf.
  • From our partners or other third parties, such as our shipping carrier or payment providers.

Consent

We collect, use and disclose your personal information with your consent, except where the law allows or requires otherwise. By placing an order, creating an account or contacting us, you consent to the collection and use of your personal information for the purposes described in this Privacy Policy. Where we rely on your express consent, for example to send you marketing emails, we ask for it separately and you may withdraw it at any time, subject to legal or contractual restrictions and reasonable notice, by contacting us or by using the unsubscribe link in our emails. Withdrawing your consent may mean that we are unable to provide you with certain Services.

How we use your personal information

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

  • Providing, tailoring and improving the Services. We use your personal information to provide you with the Services, including to perform our contract with you, to process your payments, to fulfill and ship your orders, to send you notifications related to your account, orders and returns, to remember your preferences and items you are interested in, to create, maintain and otherwise manage your account, to facilitate any returns and refunds, to enable you to post reviews, and to create a customized shopping experience for you, such as recommending products related to your purchases.
  • Marketing and advertising. With your consent, we use your personal information to send you marketing and promotional communications by email, in compliance with Canada's Anti-Spam Legislation (CASL). We may also show you online advertisements for our products on other websites, including based on items you previously purchased or added to your cart and other activity on the Services.
  • Security and fraud prevention. We use your personal information to authenticate your account, to provide a secure payment and shopping experience, and to detect, investigate or take action regarding possible fraudulent, illegal, unsafe or malicious activity. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe.
  • Communicating with you. We use your personal information to provide you with customer support, to respond to your questions and to maintain our business relationship with you.
  • Legal reasons. We use your personal information to comply with applicable law or respond to valid legal process, including requests from law enforcement or government agencies, to investigate or participate in civil discovery, potential or actual litigation or other adversarial legal proceedings, and to enforce or investigate potential violations of our terms or policies.

Cookies and similar technologies

Like many websites, we use cookies and similar technologies to operate and improve the Services, to remember your preferences and cart, to measure how the Services are used and to support our marketing. Cookies that are strictly necessary for the website and checkout to work are always active. Where required by the law of your province, analytics and advertising cookies are only set after you have given your consent through our cookie banner, and you can change your choice at any time. You can also control cookies through your browser settings; blocking some cookies may affect how the Services work for you. For more information about the cookies Shopify uses on our behalf, see Shopify's cookie policy.

How we disclose personal information

We do not sell your personal information. In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:

  • With Shopify, our shipping carriers, our fulfillment partners, payment processors and other service providers who perform services on our behalf (for example IT management, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping). These providers may only use your personal information to provide their services to us.
  • With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalized advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices.
  • When you direct, request or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
  • With our affiliates or otherwise within our corporate group.
  • In connection with a business transaction such as a merger, acquisition or bankruptcy, to comply with applicable legal obligations (including responding to subpoenas, search warrants and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights and the rights of our users or others.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Services for you. In addition, to help protect, grow and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our store, along with other merchants and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over the use of your personal information for these purposes. To learn more about how Shopify uses your personal information and any rights you may have, you can visit the Shopify Consumer Privacy Policy and the Shopify Privacy Portal.

International transfers

We are based in the United States, and our service providers, including Shopify, operate in the United States and other countries. Your personal information may therefore be transferred to, stored and processed outside Canada and outside the province in which you live. While it is outside Canada, it is subject to the laws of those countries and may be accessible to their courts, law enforcement and national security authorities. We take reasonable steps, including contractual protections, to ensure that your personal information receives a comparable level of protection wherever it is processed.

Third-party websites and links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated with or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness or reliability of information found on them. Information you provide in public or semi-public venues, including on third-party social networking platforms, may be viewable by other users of the Services and users of those platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

Children's data

The Services are not intended to be used by children, and we do not knowingly collect personal information from anyone under the age of majority in their jurisdiction, or under 14 years of age in Quebec, without the consent of a parent or guardian. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details below to request that it be deleted.

Security and retention of your information

We protect your personal information with safeguards appropriate to its sensitivity. Our website and checkout use TLS/SSL encryption, and payments are processed by Shopify, which is certified Level 1 PCI DSS compliant. Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security". We recommend that you do not use unsecured channels to communicate sensitive or confidential information to us. If a confidentiality incident involving your personal information presents a risk of serious injury, we will notify you and the relevant authorities as required by law.

We keep your personal information only as long as necessary for the purposes described in this Privacy Policy and to comply with our legal obligations, resolve disputes and enforce our agreements. As a rule, we keep order and transaction records for 7 years for tax and accounting purposes; account information until you ask us to delete your account; and marketing preferences until you unsubscribe. When personal information is no longer needed, it is securely deleted or anonymized.

Your rights and choices

Subject to applicable law, you have the following rights in relation to your personal information:

  • Access. You may ask us to confirm whether we hold personal information about you and to give you access to it.
  • Correction. You may ask us to correct personal information that is inaccurate, incomplete or out of date.
  • Withdrawal of consent. You may withdraw your consent to the collection, use or disclosure of your personal information at any time, subject to legal or contractual restrictions.
  • Deletion and de-indexing. You may ask us to delete your personal information, or to stop disseminating it, where permitted by the law of your province.
  • Portability. Where the law of your province provides for it, you may ask to receive the computerized personal information we collected from you in a structured, commonly used technological format, or to have it transferred to another organization.
  • Marketing preferences. You may opt out of marketing emails at any time by using the unsubscribe link in any email or by contacting us. We may still send you non-promotional emails, such as those about your account or orders.
  • US state privacy rights. If you reside in a US state with an applicable privacy law, you may have the right to opt out of the "sale" or "sharing" of your personal information or of targeted advertising. You can exercise this right on our Your Privacy Choices page. If you visit our website with the Global Privacy Control signal enabled, we treat it as an opt-out request for that browser and device where the law requires it.

You may exercise these rights by contacting us using the details below. We may need to verify your identity before processing your request, and we will respond within the time required by applicable law (generally 30 days). We will not discriminate against you for exercising any of these rights.

Complaints

If you have a concern about how we handle your personal information, please contact our Privacy Officer first; we will investigate and respond. If you are not satisfied with our response, you may file a complaint with the Office of the Privacy Commissioner of Canada (www.priv.gc.ca) or, if you live in Quebec, with the Commission d'accès à l'information du Québec (www.cai.gouv.qc.ca), or with the privacy regulator of your province.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal or regulatory reasons. We will post the revised Privacy Policy on this website, update the "Last updated" date and provide notice as required by applicable law.
